SMS Policy

  1. Purpose. This SMS Policy (“Policy”) outlines the terms and conditions under which the De Vos Urban Leadership Initiative (“DVULI”, “we”, “us” or “our”) sends text messages, also known as SMS, to its members, participants, and alumni.
  2. Opt-In. By providing your mobile number to DVULI as part of your enrollment in a DVULI program (“Program”) or by affirmatively opting in to receive text messages, such as through online or application-based forms offered by DVULI, you consent to receive text messages from DVULI, including text messages sent by an automatic telephone dialing system (“ATDS”) that include class reminders, updates, or cancellations and other relevant information about the Program, reminders and/or details for other DVULI programs or events, or other information relevant to your relationship with DVULI. 
  3. Opt-Out. You can opt-out of receiving SMS messages at any time by replying “STOP”, “UNSUBSCRIBE”, or “CANCEL” to any message. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you would like to sign up to receive SMS messages again after opting out, please sign up by texting “START” to the number from which you received SMS messages, and we will resume sending automated SMS messages to you again.
  4. Privacy. Your privacy is important to us. We will not share, sell, or distribute your mobile phone number to third parties without your consent, except as required by law. For more information, please review our privacy policy, available at https://www.dvuli.org/privacy-policy/
  5. Message and Data Rates; Frequency. Message and data rates may apply. You are responsible for any fees incurred from your mobile service provider. If you have any questions about your text plan or data plan, it is best to contact your mobile service provider. Messages are recurring, and the frequency of those messages may vary.
  6. Carriers. Supported carriers include all major United States carriers including, AT&T, Verizon Wireless, T-Mobile®, Sprint, and others. 
  7. Your Mobile Number. You agree to maintain accurate, complete, and up-to-date information with DVULI, including, without limitation, notifying DVULI in writing immediately if you change your mobile number, or cease being the regular user of your mobile number. You will not initiate text messages to or send text messages from the mobile number of any other person or entity. You agree to indemnify, defend, and hold harmless DVULI from and against all claims, losses, expenses, damages, judgments, costs, and fees, including reasonable attorneys’ fees, that may be imposed on, incurred by, or asserted against DVULI, in any way relating to, caused by, or arising out of providing DVULI a telephone number that you do not own, or your failure to notify DVULI that your mobile number has changed or that you are no longer the regular user of your mobile number, including, but not limited to, all claims, expenses, damages, fees, and costs related to or arising under the Telephone Consumer Protection Act and related Federal Communications Commission implementing rules.
  8. No Liability. DVULI will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your mobile service provider. Carriers are not liable for delayed or undelivered messages. SMS MESSAGE SERVICES ARE PROVIDED ON AN “AS IS” BASIS, AND WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, AND ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE HEREBY EXPRESSLY DISCLAIMED. DVULI is not responsible and will not be liable for any other damages of any nature, including any incidental, special or consequential damages (such as lost profits or lost business opportunities), or punitive damages. DVULI reserves the right to terminate the texting service, in whole or in part, at any time without notice.
  9. Customer Support. If you need assistance or have any questions regarding our SMS service, reply “HELP” to any of our text messages or contact us at (616) 643-4848 or staff@dvuli.org.
  10. Policy Changes. DVULI reserves the right to modify this SMS Policy at any time. Any amendments will be effective upon our posting of the updated Policy on this Site. If you have opted-in to receive SMS messages, we may send a text message to note that this Policy has been amended. If you remain opted-in to receive SMS messages following such notice, you thereby agree to the amended Policy. Your sole remedy if you do not agree with the revised Policy is to opt out as provided in this Policy.
  11. Applicable Law. This Policy is governed by the laws of the State of Michigan.
